Trademark Registration Procedure for Non-Residents of Ukraine

Non-residents can register a trademark in Ukraine without the need to physically visit the country. The general procedure includes:

  1. Power of Attorney (PoA):
    A non-resident must authorize a registered Ukrainian patent attorney through a Power of Attorney. In most cases, no notarization or legalization is required.
  2. Trademark Search (optional but recommended):
    Before filing, we recommend conducting a preliminary search to assess the chances of successful registration and avoid conflicts with existing trademarks.
  3. Application Filing:
    The application is submitted to the Ukrainian Intellectual Property Institute (Ukrpatent). It must include a clear image of the trademark, a list of goods and/or services according to the Nice Classification, and applicant details.
  4. Formal Examination:
    Ukrpatent examines the application to ensure it complies with formal requirements.
  5. Substantive Examination:
    Ukrpatent checks for grounds for refusal (for example, similarity with existing trademarks, descriptiveness, or misleading elements).
  6. Publication and Opposition Period:
    If the application passes the examination, it is published in the official bulletin. Third parties have a three-month period to oppose the registration.
  7. Registration Certificate Issuance:
    If there is no opposition or the opposition is unsuccessful, the trademark is registered, and the Certificate of Registration is issued.
  8. Validity and Renewal:
    A Ukrainian trademark is valid for 10 years from the filing date and can be renewed for successive 10-year periods.

Additional Important Points

  • Duration:
    On average, the trademark registration process in Ukraine takes 12–18 months. However, an accelerated procedure is available for an extra fee, reducing the process to approximately 6–8 months.
  • Trademark Use:
    In Ukraine, a trademark must be used to maintain its protection. If a trademark is not used for five consecutive years, it may be subject to cancellation upon a third-party request.
  • International Protection:
    Ukraine is a member of the Madrid System. This allows applicants to extend their trademark protection internationally through a single application based on a Ukrainian trademark registration.
